24hr care or care at home

Our LA have assessed as requiring 24hr care however say this can’t be provided at home and can only be provided in a care home setting which is completely against the adults wishes and their POA. The LA say they can’t fund the level of care required at home and they would only extend to fund equivalent cost of care home placement.
The budget equates to 4.5 hrs per day despite assessment recommendation of 24hr care.
Is this the same across all authorities

Hi @Dora, I’m pretty sure that this is not the same across all LAs (nothing ever is with social care/SDS) and I am certainly aware of people who are funded to live at home who would probably be considered to require 24/7 care, although I can’t say exactly how this is funded and there may be unpaid carers involved as well.

When you say “the budget equates to 4.5 hrs per day,” is this the budget that LA are offering for home care? If so, is this the maximum they will fund via Option 3? Would they be willing to fund more hours via a direct payment/Option 1?

If it is against the adult’s wishes, then it should not happen (easy to say) and you can challenge this via the social work complaints procedure and/or local councillors/MSPs etc. You may also be able to get advice and support from a local independent advice or brokerage organisation here: Find Local Information and Support - Self Directed Support Scotland (sdsscotland.org.uk)
